| Conditions of Use
Permission is for one-time use only with no other rights. Any subsequent use consitutes re-use and must be applied for in writing to the Tacoma Public Library.
This purchase does not constitute permission to use this image on a web server or web site. You must apply in writing to use any Tacoma Public Library image on a web site.
All reproductions and use must be credited to the Tacoma Public Library.
With printed matter, the image negative number and the photographer or collection name, when provided, must be included
in a credit line. The credit line must appear with the item, or on a credit page indicating the page number and the location on the page for each item.
Crediting of each item is mandatory in all cases.

With film, filmstrips, slide presentations and video productions, credit must appear with other credits at the beginning
or the end of the production. Image negative numbers may be omitted from the credit if desired.

Exemption from these requirements must be approved in advance and in writing by the Tacoma Public Library.
The Library requests that one complimentary copy of each publication (excluding film) in which the photographic copy appears be sent to the Tacoma Public Library -- NorthWest Room.
The user may not reproduce, or permit others to reproduce, the photographic copy or any facsimile of it or image derived from it. Additional copies of any image must be purchased from
the Tacoma Public Library.
Unless authorized in advance, images may not be cropped or altered to any significant extent that would compromise the integrity of the original image.
The historical, aesthetic, literary, artistic and factual integrity of Index materials should be maintained.
Materials shall not be distorted or manipulated by digital technology except by the use of standard compression software in order to conserve storage
space, or to enhance the visual clarity of the image. The materials will not be used in a context that is deliberately trivializing or misleading.
In authorizing the publication of a photographic copy, the Tacoma Public Library does not surrender its own right to exhibit, publish or otherwise reproduce the materials, nor grant permission
to others to do so.
All responsibility for possible copyright infringement and invasion of privacy arising from use of reproductions is assumed by the user.
Fair Use and Copyright
The copyright law of the United States (Title 17, U.S. Code) governs the making of photocopies or any other reproductions of copyrighted materials.
Tacoma Public Library is not responsible for the improper or illegal use of any copies of materials from its collections. It is the user's
responsibility to guard against the infringement of rights that may be held by others and for clearing reproduction rights and copyright restrictions.
Tacoma Public Library does not claim to control the copyright for all pictorial and textual materials in its collections. Library staff will provide any information available for specific items that
it has available to the user in this regard if a specific request is made.
The Library provides such information as a service to aid patrons in determining the appropriate use of an item, but that determination ultimately rests with the patron.
It is the patron's obligation to determine and satisfy copyright or other use restrictions when publishing or otherwise distributing materials from the Library's collections.
Patrons are reminded that these materials are provided by the Tacoma Public Library for non-profit educational, personal or scholarly purposes and that transmission or reproduction of protected items
beyond that allowed by fair use requires the written permission of the copyright holders.
Issues pertaining to privacy and publicity may arise when a researcher contemplates the use of materials found in library collections. Because two or more people are often involved
(photographer and subject) and because of the ease with which images can be reused, photographs represent a type of document in which issues of privacy and publicity emerge with some frequency.
Privacy and publicity rights are, of course, distinct from copyright. In addition, while it is true that famous people or public figures
who seek recognition have already surrendered some privacy, they may have the right to control the commercial use of their images (likeness, voice, signature, etc.).
This principal recognizes that a celebrity's image can be an asset in trade. Users are solely responsible for determining the existence of such rights and for obtaining any permissions, and paying any associated fees, which may be necessary for the proposed use.
The Tacoma Public Library is eager to hear from any copyright owners who are not properly identified so that appropriate information may be provided in the future.
Legal Notices
Prices are subject to change without notice. All products are sold "as is" and are dependent on the quality
of the photographic original or copy from which they are created. Except for cases where the print, slide, printout or scanned image file
is clearly flawed in production in a manner not related to the orginal image quality, there will be no refund for such products. In such a case the sole remedy will be that the Library will use our best efforts to create a higher quality comparable replacement
for that print, slide, printout or scanned file. If in the meantime the original image has deteriorated to such an extent that a quality reproduction
cannot be created, or the original image has been lost or destroyed, then the sole remedy will be that the Library will refund the cost associated with that image.
A Privacy note
The identifying information you send us -- name, mailing address, e-mail address, or phone number -- will only be used by the Tacoma Public Library
for the purpose of filling this order and maintaining normal financial records relating to your purchase. No personal information is sent electronically
over the internet.
The Tacoma Public Library will not store or use this personal information for other than normal business purposes.
